The complaint alleges that construction crews removed dirt, crushed rock for road materials, and altered the property’s drainage systems—all without the developer’s consent. It also accuses the tribe of using the land "as if it belonged to the tribe," significantly devaluing it in the process.

In response, Kings Mountain Land Development Partners is seeking compensatory damages, punitive damages, and injunctive relief. The developer has also revoked an easement granted to the tribe in 2021, citing repeated violations.

The developer claims to have worked closely with the tribe for years, selling multiple parcels of land for the casino’s development and negotiating payment agreements.
